MTO failed to legalize reduced speed zone near Caledon Village

A little research by an Orangeville resident whose wife was ticketed for speeding in a posted 60 km/h zone approaching Caledon Village has turned up evidence that the reduced speed was never codified.

The resident told the Citizen Tuesday that the failure to change the speed limit regulation was confirmed by a Transportation ministry spokesman who said the ‘60’ signs would have to be removed, at least temporarily.

A check of the government’s website confirmed that Schedule 12 of the speed limit regulation RRO619 shows that the 80 km/h speed limit on Highway 10 applies between Victoria hamlet and the southern edge of Caledon village – “between a point situate 180 metres measured northerly from its intersection with the northerly limit of the roadway known as Peel Regional Road No. 9 and a point situate 610 metres measured southerly from its intersection with the northerly limit of the King’s Highway known as No. 24 [now Peel Region 24}”.

Similarly, to the north, the 80 km/h limit is “between a point situate 600 metres measured northerly from its intersection with the northerly limit of the junction of the King’s Highway known as No. 10 and the King’s Highway known as No. 24 in the Town of Caledon in The Regional Municipality of Peel and a point situate 160 metres measured northerly from its intersection with the centre line of the roadway known as First Street in the Town of Orangeville in the County of Dufferin.” Put more simply, that means the 80 limit is continuous from the northern edge of Caledon village to just north of the First Street intersection, where the highway is correctly posted at 60 km/h as far north as Hockley Road.

Needless to say, the resident’s wife plans to fight the ticket and may well be joined by many others who have faced stiff fines and at least two demerit points for exceeding a non-existent speed limit.
